Wrongful death lawsuit filed in todder's death

A wrongful death lawsuit was filed Thursday in the death of a toddler who died from injuries sustained in a recent traffic accident. It was filed by attorneys representing Brittany Carroll whose two year old daughter, Pasleigh Elizabeth Carroll, was killed in the December 11 wreck.

Pasleigh was a passenger in a SUV that struck semi-tractor trailer when the truck pulled onto Alabama Highway 52 (Columbia Highway) from Omussee Road in Dothan. Pasleigh died a few hours after the accident from severe internal and other injuries.

The driver of the SUV, Jana Calhoon, was critically hurt in the accident but is making what family describes as a “slow” recovery. She is expected to file a separate lawsuit in the near future.

Named as defendants in the Carroll lawsuit are Timothy Wade Shiver, N&J Transportation of Dothan, and Schnitzer Southeast LLC. Shiver was the driver of the truck, N&J the owner, and the trailed pulled is owned by Schnitzer..

The 10-page lawsuit alleges negligence on the part of the defendants, including Shiver who was driving the 18-wheeler. It was filed by Rip Andrews of the Birmingham firm of Marsh, Rickard, and Bryan.

The lawsuit requests a jury trial and seeks damages in an amount to be determined.
