Defense attorney William White argued the solicitation charge in Henry County should be dropped because his client is facing the same charge in Covington County. White argued the allegations involve the same electronic device and was part of the one act.
“I strongly believe this should be one case,” White told District Judge Derek Peterson. “Beyond double jeopardy we’re trying to avoid expense for my client as well as the state,” he argued.
“We dispute that,” countered Assistant District Attorney Sam Clenney. Peterson agreed and bound the Henry County charges to the grand jury.
Driver, 24, was arrested May 14 in Henry County after he allegedly sent nude photos to what he believed was an underage girl and tried to arrange a meeting for the purpose of engaging in sexual activity. He was actually communicating with an undercover investigator according to testimony. Driver was arrested in Covington County two days later.
Driver recently graduated from Troy University with a degree in elementary education and completed an internship according to an investigator quoted in an article published May 19 by the Dothan Eagle.
