Judge rejects convicted child rapist pleas

Donald Lacey had sought new trial, different sentence in alleged attack on 10-year old child.
A Houston County judge refused Monday to reconsider a 99 year prison sentence given a man convicted earlier this year of raping a young girl in Dothan. Donald Lacey’s request for a new trial was also denied following a hearing.

Prosecutors say the rape occurred when Lacey and the 10-year old victim, who is from southwest Alabama, were both were staying in Dothan. Lacey was arrested at a Panama City motel in July, 2013; a few weeks after the alleged sexual assault took place. He was convicted in January and sentenced a month later.

Lacey was represented during the hearing by prominent Montgomery attorney Susan James. She is the fifth attorney to represent Lacy and the only one retained. The others were court-appointed according to records.

The ruling denying Lacey’s were made by Circuit Judge Butch Binford who presided of the trial.
