Father seeks justice against two area businesses

COFFEE COUNTY, Ala.--Earlier last year a 19-year-old Elba resident and Enterprise State Community College student died when the vehicle she was driving collided with another vehicle.

A second person also died as a result of the crash.

Now a lawsuit has been filed in Coffee County by the driver's father who hopes of sending a strong message.

"She was bright, beautiful, very vibrant, people loved her," said Blaine Stevens, Attorney of Chris English.

In 2016 19-year-old Elba resident Elizabeth Farris English known to her friends as Farris was killed on her way home to Enterprise on 167 North.

"The wreck happened just outside of Enterprise, it was a head on collision with another vehicle, Farris was killed, the driver of the other vehicle was killed and the remaining persons were injured," said Stevens.

Earlier that evening English was with friends at two area businesses.

"We've got a forensic sciences report that shows that her blood alcohol level at the time of her death was .144," said Stevens.

Now Chris English, the father of Elizabeth Farris English has filed a complaint in the Circuit Court of Coffee County alleging that Beef O' Brady's in

Enterprise and The Front Porch in Troy had a role in her death according to Alabama Law.

"We're seeking to enforce two statutes that are intended to protect the public and to protect minors nd we want a verdict from a jury in this case that will send a message," said Stevens.

The two statutes cited were The Civil Damages Act, which provides a cause of action of a person who's injured by the sale of alcohol to a minor, and The Dram Stamp Act, which forbids the sale of alcohol by any vendor to a person who is already visibly intoxicated.

"If you sell alcohol to a minor then there are consequences to that if the minor's injured, if the minor injures someone else. There are consequences," said Stevens.

The complaint was filed September 25, 2017 and once served, the defendants have 30 days to respond.

WDHN reached out to Beef O' Brady's and The Front Porch for a comment, so far they have not issued a statement.
